In September 2018, the Constitutional Court of South Africa declared that the private use, possession, and cultivation of cannabis by adults in private spaces is protected under the right to privacy in Section 14 of the Constitution. This effectively decriminalised personal adult cannabis use.
Following this, the Cannabis for Private Purposes Act 4 of 2024 was signed into law, formalising the decriminalisation of private adult cannabis use and providing for the expungement of certain prior convictions related to personal cannabis use.
However, the commercial sale of cannabis remains in a legal gray area. No comprehensive retail licensing framework has yet been fully implemented. The South African government is in the process of developing regulatory frameworks for a legal cannabis market.

Section 21 of the Medicines and Related Substances Act 101 of 1965 provides a mechanism for the South African Health Products Regulatory Authority (SAHPRA) to authorise access to unregistered medicines and substances in specific circumstances — including for therapeutic or personal use.
